These Terms of Service apply when you use our website or purchase products from us. Please read them carefully before placing an order.
Nothing in these terms affects your statutory rights as a consumer.
2. Who these terms apply to
These terms apply to purchases made by consumers for personal and domestic use.
If you purchase products wholly or mainly for business, commercial, trade or professional purposes, separate trade terms or any written agreement between us may apply.
You must be at least 18 years old and legally capable of entering into a contract to place an order with us.
3. Product information
We take reasonable care to ensure product descriptions, photographs, dimensions, prices and other information on our website are accurate.
Colours can appear differently depending on your screen, lighting and surroundings. Samples should be used as a guide, but variations may occur between samples and finished products.
Many of our products use natural or handmade materials, including marble, stone, wood, glass, ceramics and textiles. Variations in colour, grain, veining, pattern, texture, finish or small differences in dimensions are characteristic of these materials and will not normally be considered faults.
Product dimensions are approximate unless expressly stated otherwise. You are responsible for checking that a product is suitable for its intended location and that there is sufficient access for delivery.
4. Placing an order
When you place an order, you are making an offer to purchase the products in your basket.
An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that we have accepted it.
For in-stock products, a contract is normally formed when we send confirmation that the order has been dispatched.
For made-to-order products, a contract is formed when we expressly accept the order and begin processing it with our supplier or manufacturer.
We may decline or cancel an order before acceptance where, for example:
-
A product is unavailable
-
Payment cannot be authorised
-
There is an error in the price or product information
-
Delivery cannot be made to the address supplied
-
We reasonably suspect fraudulent or unauthorised activity
If we cancel an order after taking payment, we will refund the relevant amount.
Please check all order details carefully, particularly the delivery address and any selected fabric, finish, dimensions, orientation, leg style or configuration.
5. Prices and payment
Prices are shown in pounds sterling and include VAT where applicable.
Delivery and any additional service charges are shown separately before you complete your order.
We may change prices at any time, but this will not normally affect an order we have already accepted.
If a pricing or product-information error is obvious and could reasonably have been recognised as an error, we may cancel the order and refund any amount paid.
Payment must be made using one of the payment methods offered at checkout. Products remain our property until we have received payment in full.
6. Promotions and discount codes
Promotional offers and discount codes are subject to any additional conditions stated with the promotion.
Unless we say otherwise:
-
Only one promotional code may be used per order
-
Codes cannot be exchanged for cash
-
Codes cannot be applied retrospectively
-
Excluded products or collections may apply
-
Promotions may be changed or withdrawn before an order is placed
Your statutory rights are not affected when purchasing discounted or sale products.
7. Made-to-order products
A made-to-order product is manufactured or prepared after you place your order.
Products selected from the standard options offered on our website may include choices such as fabric, finish, size, orientation, legs or configuration. Although these products are made to order, eligible products are covered by our voluntary 14-day furniture returns promise, as explained in our Furniture Returns Policy.
A genuinely bespoke product is one made to specifications requested by you outside the standard options offered on our website. Genuinely bespoke or personalised products may not be eligible for change-of-mind cancellation or return once production has begun.
We will identify any genuinely bespoke order before it is confirmed wherever reasonably possible.
If you wish to amend or cancel a made-to-order order before delivery, contact us as soon as possible. We will try to accommodate the request, but changes or cancellation may not be possible once production has begun.
This does not affect your rights where a product is faulty, damaged, incorrectly supplied or not as described.
8. Delivery
Our current delivery options, charges, service levels and estimated timescales are set out in our Delivery Policy.
Delivery dates and lead times are estimates unless we expressly agree a fixed date with you.
In-stock furniture is normally delivered within approximately 7–10 working days. Made-to-order furniture typically has a lead time of approximately 8–10 weeks, although this may vary by product.
We will contact you when made-to-order furniture is ready to arrange delivery. If you cannot accept delivery, please tell us within 48 hours. Where delivery cannot be accepted within the requested period, an £80 storage surcharge may apply, as described in our Delivery Policy.
You are responsible for:
-
Providing a complete and accurate delivery address
-
Ensuring suitable access to the property and intended room
-
Checking doorways, corridors, staircases, lifts and turning spaces
-
Telling us about access restrictions before delivery
-
Ensuring any necessary permissions, parking or access arrangements are in place
If delivery cannot be completed because access information was not supplied or the product does not fit, reasonable redelivery, collection or return costs may apply.
Responsibility for the product passes to you when it is delivered into your physical possession or to a person identified by you to receive it.
9. Inspecting furniture on delivery
Where furniture is delivered using a room-of-choice or white-glove service, please inspect it before the delivery team leaves whenever reasonably possible.
If packaging is removed by our delivery team, this does not by itself prevent an eligible return.
Please tell the delivery team and contact us promptly if you notice visible damage, an incorrect item or missing components. Reporting visible damage promptly helps us investigate with the delivery provider, but a delay in reporting does not remove your statutory rights.
10. Changing your mind
Our returns arrangements depend on the type of product purchased.
Homeware and standard parcels
Most eligible homeware may be returned within 30 days after delivery, subject to the conditions and exclusions in our Returns Policy.
Return options currently include:
-
A DPD return label for £9, covering up to three parcels
-
A DPD home collection for £15
-
Return using your own suitable tracked and insured courier
Furniture
Eligible furniture, including eligible products made to order from the standard options on our website, may be returned under our voluntary 14-day furniture returns promise.
You must tell us that you wish to return the furniture within 14 calendar days after delivery.
Our UK mainland furniture collection charges are currently:
-
Standard furniture collection: £100
-
Marble coffee tables and other products requiring a specialist two-person collection: £150
-
Marble side tables that can safely be handled through our standard furniture service: £100
Where specialist packaging or a protective crate was left with you but has not been retained, an additional reasonable charge may apply for replacement packaging or re-crating. We will explain and confirm any additional charge before arranging collection.
Full conditions are set out in our Furniture Returns Policy.
The furniture collection service and stated collection charges apply to UK mainland addresses only. Please contact us before ordering or returning furniture from any other location.
11. Condition of returned products
You may inspect a product as you would reasonably be able to inspect it in a shop.
Returned products should be kept in good condition and handled only as necessary to establish their nature, characteristics and suitability.
We may make a reasonable deduction from a refund where handling beyond what is reasonably necessary has reduced the product’s value. Any deduction will reflect the actual reduction in value and will be explained to you.
Original packaging should be retained where reasonably possible, particularly for fragile, marble, stone or glass products. However, the absence of original packaging does not automatically remove a statutory right to cancel or return a product.
If we arrange a furniture collection, normal protective wrapping is included in the stated collection charge. Additional reasonable costs may apply where specialist packaging or a crate was originally left with you but was not retained.
You remain responsible for products returned using your own courier until they are received by us. We recommend using a tracked, insured service appropriate for the size, weight and value of the product.
12. Refunds
Approved refunds will normally be made to the original payment method.
Where you exercise a statutory right to cancel an eligible online order, we will also refund the basic outbound delivery charge. If you selected a more expensive delivery option, we are only required to refund the cost of our least expensive standard delivery service.
We may withhold a refund until we have received the returned product or you provide evidence that it has been sent back, whichever occurs first.
Refunds will be processed within the applicable statutory period. Your bank or payment provider may take additional time to show the funds in your account.
Any agreed return or collection charge may be deducted from your refund.
13. Faulty, damaged or incorrectly supplied products
Products must be of satisfactory quality, fit for purpose and as described.
If a product is faulty, damaged, incorrectly supplied or materially different from its description, contact us at info@layeredlounge.com with:
-
Your order number
-
A description of the problem
-
Clear photographs or video where this will help us assess the issue
We may arrange an inspection, repair, replacement, collection or refund depending on the circumstances and your legal rights.
You will not be charged a return or collection fee for a product confirmed to be faulty, damaged, incorrectly supplied or not as described.
Nothing in these terms limits your rights under the Consumer Rights Act 2015 or other applicable consumer law.
14. Delays and events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control.
These may include severe weather, transport disruption, supplier or manufacturing delays, industrial action, fire, flood, epidemic, government action, import disruption or failures in telecommunications or delivery networks.
If a significant delay occurs, we will contact you where reasonably possible and take steps to minimise its effect. Your legal rights in relation to serious delays remain unaffected.
15. Our responsibility to you
We are responsible for foreseeable loss or damage caused by our breach of these terms or by our failure to use reasonable care and skill.
We are not responsible for loss or damage that was not foreseeable or that results from:
-
Incorrect information supplied by you
-
Failure to follow product-care instructions
-
Misuse, neglect, accidental damage or unauthorised repair
-
Normal wear and tear
-
Natural variations inherent in the product’s materials
-
Use of a product for commercial purposes where it was sold for domestic use
We do not exclude or limit liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability arising under your statutory consumer rights.
If you are a consumer, we are not responsible for business losses, including loss of profit, revenue, business opportunity or business interruption.
16. Website availability and acceptable use
We may update, change, suspend or withdraw any part of the website where reasonably necessary.
You must not use the website:
-
For unlawful or fraudulent purposes
-
To transmit viruses or harmful code
-
To interfere with the website’s security or operation
-
To collect information about other users without authority
-
To infringe our rights or the rights of another person
-
To submit false, misleading, abusive or offensive content
We may restrict access where we reasonably believe these terms have been breached.
17. Intellectual property
The website and its content, including text, photography, graphics, designs, branding, logos and product presentation, belong to Layered Lounge or our licensors and are protected by intellectual-property laws.
You may view and use the website for personal, non-commercial purposes. You may not reproduce, distribute, modify or commercially exploit its content without prior written permission.
18. Reviews and submitted content
If you submit a review, photograph, comment or other content to us, you confirm that:
-
You own it or have permission to submit it
-
It is accurate and based on your genuine experience
-
It does not infringe another person’s rights
-
It is not unlawful, defamatory, abusive or misleading
You grant us a non-exclusive, royalty-free licence to display and use that content in connection with our business and marketing. We may remove submitted content where we reasonably consider it inappropriate or unlawful.
19. Privacy and cookies
We process personal information in accordance with our Privacy Policy.
Our website also uses cookies and similar technologies as described in our cookie information and consent settings.
Third-party services, including payment, analytics, marketing and delivery providers, may process information in accordance with their own privacy policies.
20. Third-party links and services
Our website may contain links to third-party websites or services. These are provided for convenience and do not mean that we endorse or control those websites.
We are not responsible for third-party content, availability, security or privacy practices.
Purchases made directly from a third party are subject to that party’s own terms.
21. Changes to these terms
We may update these terms from time to time to reflect changes in our services, policies, business or applicable law.
The terms applying to an order will normally be those in force when the order was placed. Changes will not retrospectively reduce your contractual or statutory rights.
The date of the latest update appears at the top of this page.
22. Transfer, waiver and severability
We may transfer our rights and obligations under these terms to another organisation, provided this does not reduce your rights.
You may only transfer your rights or obligations with our written agreement, except where applicable law gives you the right to do so.
If we do not immediately enforce a provision of these terms, this does not mean that we have waived it.
If any provision is found to be unlawful or unenforceable, the remaining provisions will continue in effect.
No person other than you and us has a right to enforce these terms.
23. Governing law and disputes
These terms and any contract between you and us are governed by the laws of England and Wales.
If you live in England or Wales, the courts of England and Wales will have jurisdiction.
If you live in Scotland or Northern Ireland, you may bring proceedings in your local courts or in the courts of England and Wales.
We will always try to resolve a complaint directly. Please contact us first at info@layeredlounge.com.
